Overview
Welcome to BootSki. The terms "we", "us" and "our" refer to BootSki, operated by Wiliams Brandon Blanco Jaldín, Calle Virgen de los Dolores 20, 41940 Tomares, Seville, Spain. BootSki operates this store and website (www.bootski.store), including all related information, content, features, tools, products and services (the "Services"). The Services are powered by Shopify.
These Terms of Service ("Terms"), together with the policies referenced here, describe your rights and responsibilities when using the Services. By visiting or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
Section 1 – Access and account
By agreeing to these Terms, you confirm that you are at least the age of majority in your place of residence, or that you are using the Services with the consent and supervision of a parent or legal guardian.
You agree that all information you provide (such as your email, billing, payment and shipping details) is accurate, current and complete. You are responsible for keeping your account credentials secure and for all activity under your account.
Section 2 – Our products
We make every effort to display our products accurately. Colours and appearance may vary slightly depending on your screen. Images and videos are for illustrative purposes; the experience depends on your skill, the snow conditions and the terrain.
We may update product descriptions, discontinue products or limit quantities at any time.
Section 3 – Product use and safety
BootSki™ is a recreational product for sliding on snow. Like any snow activity, using it involves a risk of falls and injury. By using it, you agree to:
- Read and follow the included instructions, and check that straps and buckles are properly fastened before every use.
- Wear a helmet and appropriate protective gear. We strongly recommend them.
- Use it only on snow, at a speed you can control, and away from roads, traffic, frozen water, cliffs, trees and other obstacles.
- Respect the rules of ski resorts, parks and private land. Some resorts may not allow this type of product on their slopes.
- Ensure that minors always use the product under the supervision of a responsible adult.
- Not modify the product, and stop using it if it shows any damage.
Please note that BootSki™ attaches to your own footwear with straps and buckles; it does not include release bindings like traditional ski bindings and will not detach automatically in a fall.
Section 4 – Orders
When you place an order, you make an offer to purchase. We may accept or decline any order, for example in case of suspected fraud, pricing errors or lack of stock. Your order is accepted when we confirm it and your payment has been processed. If we cancel or change an order, we will notify you and refund any amount paid.
Returns and refunds are handled according to our Refund Policy. Purchases are intended for personal use and not for resale.
Section 5 – Prices and payment
Prices, discounts and promotions may change without notice. The price charged is the one shown at the time of your order and in your order confirmation. Shipping is free worldwide and import duties and taxes are included, as described in our Shipping Policy.
Promotions may have their own terms; if they conflict with these Terms, the promotion terms apply. You confirm that you are authorised to use the payment method you provide.
Section 6 – Shipping and delivery
Delivery times are estimates. Shipping, tracking, delays and lost parcels are covered in our Shipping Policy.
Section 7 – Intellectual property
All content of the Services, including the BootSki™ name and logo, texts, images, videos and design, belongs to BootSki or its licensors and is protected by intellectual property laws. You may use the Services only for personal, non-commercial purposes and may not copy, reproduce or distribute any content without our prior written consent. Shopify's names and logos are trademarks of Shopify.
Section 8 – Third-party tools and links
The Services may include tools or links provided by third parties that we do not control. Your use of them is at your own discretion and subject to their own terms. We are not responsible for third-party content, products or services.
Section 9 – Relationship with Shopify
BootSki is powered by Shopify, which enables us to provide the Services. Any sale or purchase you make in our store is made directly with BootSki. Shopify is not responsible for any aspect of the sale between you and BootSki, including any injury, damage or loss resulting from the purchase of products. You release Shopify and its affiliates from any claims arising from your purchase and transactions with BootSki.
Section 10 – Privacy
Personal information collected through the Services is handled according to our Privacy Policy and, where applicable, Shopify's Consumer Privacy Policy. Because the Services are hosted by Shopify, information you submit may be processed by Shopify and by service providers located outside your country.
Section 11 – Reviews and comments
If you send us reviews, photos, videos, ideas or other content ("Comments"), you grant us a worldwide, royalty-free licence to use, reproduce, publish and display them in any media, including for marketing. You confirm that your Comments are your own, are truthful, do not infringe anyone's rights and do not contain unlawful or offensive material. We may remove any Comment at our discretion.
Section 12 – Errors and omissions
The Services may occasionally contain errors in descriptions, prices, promotions or availability. We may correct them and, if necessary, cancel affected orders, in which case you will receive a full refund.
Section 13 – Prohibited uses
You may use the Services only for lawful purposes. You may not use them to commit fraud, infringe intellectual property, harass others, upload malicious code, scrape data, send spam, impersonate others or bypass security measures.
Section 14 – Automated agents
Any software or automated service ("Agent") that accesses the Services on someone's behalf must clearly identify itself as an Agent, must not imitate human behaviour or bypass CAPTCHAs or other security measures, and must stop accessing the Services if we ask it to. We may limit or block Agents at our discretion.
Section 15 – Termination
We may suspend or terminate your access to the Services if you breach these Terms. Sections that by their nature should continue (such as intellectual property, liability and governing law) will survive termination.
Section 16 – Disclaimer
Except as expressly stated in these Terms or required by law, the Services are provided "as is" and "as available". This does not limit the legal guarantees and consumer rights you have under the law of your country of residence, which always apply.
Section 17 – Limitation of liability
To the maximum extent permitted by law, BootSki, its partners, suppliers and Shopify are not liable for indirect, incidental or consequential damages, or for injury or damage resulting from use of the product contrary to its instructions or to the safety recommendations in Section 3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection laws.
Section 18 – Indemnification
To the extent permitted by law, you agree to indemnify BootSki and Shopify against claims arising from your breach of these Terms or your violation of any law or third-party rights.
Section 19 – Severability and entire agreement
If any provision of these Terms is found invalid, the remaining provisions remain in effect. These Terms and the policies published on this website are the entire agreement between you and us regarding the Services. Our failure to enforce any provision is not a waiver.
Section 20 – Assignment
You may not transfer your rights under these Terms without our consent. We may transfer our rights and obligations, provided this does not reduce your rights as a consumer.
Section 21 – Governing law
These Terms are governed by Spanish law. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory laws of your country of residence, and you may bring a claim in the courts of your country of residence where the law allows it.
Section 22 – Changes to these Terms
We may update these Terms from time to time by publishing the new version on this page. The version in force when you place an order is the one that applies to that order.
